31 Jul 2012: Sayedee IO cross exam day 40

After dealing with the Golam Azam cross examination, the tribunal then moved onto the cross examination of the investigation officer in the Sayedee case, following on from the previous day
Mizanul Islam: Did you complain that the family of Ajitkumar Shill has created pressure upon him not to give witness in this case?

Witness: His son told me that if his father gives witness, his father will be killed and he will loss his job.

Defence: When did he complain like this?

Witness: I cannot remember?

Defence: Who were with you during the time of complaining?

Witness: S.I. Abdul Khalak.

Defence: Were there any member of the public there at that time?

Witness: No public was there.

Defence: Where did the son of Ajitkumar Shill work?

Witness: In the shop of a businessman of the market of Parerhat.

Defence: What is the name of that businessman?

Witness: I cannot remember.

Defence: Did you go to that businessman?

Witness: I think it is not needed.

Defence: Did you take any legal steps against that businessman?

Witness: No, I didn’t take.

Defence: Did you make any prayer to the tribunal by mentioning the name of that businessman?

Witness: No.

Defence: This witness has not been missed or not gone into hiding, actually he did not agree to make false witness against Delwar Hossain Saydee, which was why after bringing him to Dhaka and is remained three days here, it does not become possible to present him in the Tribunal.

Witness: This is not true.

Defence: You also present false report to the prosecution.

Witness: This is not true.

Defence: Son of Ajitkumar Shill didn’t make any complain to you.

Witness: It is not true.

Defence: When did you meet with witness Abdul Latif Hawlwder for the first time?

Witness: 19-08-2010.

Defence: When and where?

Witness: In the Parerhat Rajlokkhi High School from the time 15:35 to 19:00.

Defence: Did you record his statement at that day?

Witness: Yes.

Defence: Did you give notice Abdul Latif Hawlwder to be present to you?

Witness: No.

Defence: Is there the name of Abdul Latif Hawlwder in the column of witnesses of exhibition -1?

Witness: No.

Defence: Did you go to the house of Abdul Latif Hawlwder during investigation?

Witness: No, I didn’t go.

Defence: Did you go before issuing the process of this Tribunal and after investigation?

Witness: No.

Defence: How many times did Pakistani army go to the Chitoplia village?

Witness: On 8th May, only one time.

Defence: Before some days of going to Chitolia there is a description of looting in 30\35 shops by Pakistani army, this information is in the statement of Abdul Latif Hawlwder which was done to you.

Witness: Yes.

Defence: In which date, Pakistani army went to Parerhat market for the first time?

Witness: 7 may.

Defence: How many houses are burned in the house of Manik Posari’s house about it, have you any specific information?

Witness: 5 or 6 houses were burned.

Defence: Was there house of Almagir Posari’s among those?

Witness: At that time Almagir Posari was small and they lived together.

Defence: When did you go to the house of Abdul Latif Hawlader for the first time?

Witness: It is not in my note.

Defence: When you went to the house of Abdul Latif Hawlader, was there any public with you?

Witness: Mahbubul Hawlader was not there after reaching to his house but was after that.

Defence: Whom you found in the house?

Witness: His wife.

Defence: Did you record audio or video of his wife?

Witness: No.

Defence: How many children of Abdul Latif Hawlader?

Witness: I did not ask it.

Defence: Did you not meet any other family member of him without his wife?

Witness: No.

Defence: Did you enter in his house?

Witness: No, I didn’t enter.

Defence: How much time you stayed there?

Witness: may be half an hour.

Defence: Did you meet with any other at that half an hour?

Witness: Yes.

Defence: Tell their name.
Witness: I have forgotten.
Defence: Did you ask them about the position of Abdul Latif Hawlader?

Witness: Yes.

Defence: The neighbors could not give any information about Abdul Latif Hawlader.

Witness: This is not true. They told me that sometime he is seen in the house.

Defence: Did you make any order to police department to identify Abdul Latif Hawlader?

Witness: Yes.

Defence: Did they give any report?

Witness: Yes.

Defence: On which date?

Witness: Every morning and evening.

Defence: In which date they gave the report last time?

Witness: It is not in my mind when they gave report last time.

Defence: Did you summon the report which is given in police station by the person who is appointed for this responsibility whilst presenting the report to the prosecution?

Witness: No.

Defence: How many times you went to the house of Abdul Latif Hawlader?

Witness: 2\3 times, but date is not in my mind.

Defence: Was Mahbubul Alam (pw1) with you during going a second time?

Witness: No.

Defence: Who was with you?

Witness: S.I. Abdul Malek was with me.

Defence: Was he S.I. of Zia Nagar police station?

Witness: Yes.

Defence: Did you get any other in second day without his wife?

Witness: No.
Defence: Did you talk with his wife in second day?

Witness: Yes, she told me that his husband is not in the house.

Defence: After that you came from his house.

Witness: Yes.

Defence: Were there public crowded along side of you?

Witness: Yes.

Defence: Did you give your identity to them?

Witness: No, they knew me automatically because it was my second time to go there.

Defence: Were there those persons in second time who were in first time?

Witness: There were 2\1.

Defence: Did you ask them about Abdul Latif Hawlader?

Witness: Yes, they told me that they see him sometime.

Defence: When did you go there?

Witness: I can’t say the time as it is not in my mind.

Defence: Can you not say even whether morning or noon or afternoon?

Witness: I can’t say even it but I did not go during the night.

Defence: What is profession of Abdul Latif Hawlader?

Witness: Farmer.

Defence: Where is his farming-land?

Witness: In that area.

Defence: Did you get any information of him after submitting the report of prosecution?

Witness: No.

Defence: You presented Abdul Latif Hawlader to give witness to prosecution several times.

Witness: This is not true.

Defence: You and prosecution created pressure upon him to give false witness against Delwar Hossain Saydee.

Witness: This is not true.

Defence: Abdul Latif Hawlader is not presented according to your wish in the Tribunal as he not agreed to give false witness.

Witness: This is not true.

Defence: Was the process issued to every one of 27 witnesses who were present in the Tribunal?

Witness: I got summon but I presented some witnesses to prosecution without summons to face emergency because many witnesses were missing to whom process were issued. Then some witnesses were presented with the consultation of prosecution and without issuing process.

Defence: How many summons of witnesses of Jessore were given to you?

Witness: I cannot remember.

Defence: How many people you brought to produce to the Tribunal?

Witness: Three.

Defence: The summons of how many witnesses in Dhaka were given to you by prosecution?

Witness: Now I can’t say it.

Defence: To present the witnesses of Dhaka you went to how many witnesses?

Witness: I went to seven witnesses personally and they are  1. Robiul Islam. 2. Fatema Begum.
3. Md. Naser. 4. Ejab Uddin  5. Sayed Masumul Karim 6. Hossain.  7. Abed Khan.

Defence: Did you give them written order to present in the Tribunal?

Witness: I informed them about the order of Tribunal but I did not give any written order.

Then the court is adjourned.
