Before he started his evidence the tribunal chairman said that Masud Sayedee was present at the time of recording other defense witnesses and asked how the lawyers could call him as as a defense witness? Mizanul Islam replied that the fence had no plan to call him. But since following their 19(1) application the tribunal had directed the lawyers to exhibit their documents through a live witnesses, we have no other option but to call his son. He also said that the defense had no investigation officer and that Masood Sayedee would not say anything about the charges.
There was also a short discussion about the documents he wanted to admit. The defense wanted to admit the original documents, but the tribunal said that it was fine to admit photocopies. The defense lawyer said that at the end of his testimony, the witness will say that all the original documents are available to the tribunal.

I am assisting Sayedee’s defense counsels and I am his (Delwar Hossain Sayedee) third child. In this case all the documents relating to witnesses of prosecution as they are cross examined by our counsels and all other documents which were submitted by the defense to this learned Tribunal, today I came here to present those.
In 1972 regarding the killing of Ibrahim Kutti and Shaheb Ali alias Siraj Ali alias Shahabuddin, Mamtaz Begam wife of Ibrahim Kutti filed an FIR. The photocopy of that FIR is submitted here and marked as exhibit- ‘A’. The certified copy is marked here by defense witness Golam Mostofa. I gave him (Golam Mostofa) that certified copy.
The photocopy of an order of respected High Court Division of Supreme Court, writ no-5127/2009 dated 12/8/2009 is submitted here and marked as exhibit- ‘B’. My father was the petitioner of this writ case.
