22 Jul 2012: Sayedee IO cross exam day 34


After dealing with the Quasem Ali division order, the tribunal then moved onto to further cross examine Sayedee’s investigation officer. This follows on from this day.
Defence: When did you give the first summons to present Mr. Gonesh Chandra before the Tribunal?

Witness: I can’t remember.

Defence: When did you first go with summons to the office of Pirojpur SP?

Witness: I can’t remember.

Defence: When did you first take the summons to Gonesh Chandra?

Witness: I can’t recall.

Defence: You have taken several processes to present Gonesh Chandra before the Tribunal.

Witness: Yes.

Defence: What is the last date when the last steps to make him present was taken?

Witness: I can’t recall.

Defence: Did you take any steps to find him at home?

Witness: He was not found after sending some people to find him at home.

Defence: Did you take a note that- he was not found at home?

Witness: No.

Defence: You have not gone to the work place of Gonesh Chandra.

Witness: Not true.

Defence: What is his work place?

Witness: It is his house and the nearby areas.

Defence: Where is his house situated at?

Witness: At his village- Baghmara.

Defence: You didn’t watch his house.

Witness: I did. It is a tin-shed house, and there are two rooms. It is situated over 6-7 kathas of land.

Defence: Did you observe any significant something in his house other than those two rooms.

Witness: No.

Defence: What is the size of the village Baghmara?

Witness: I could not tell it by roaming.

Defence: How many times you did go to his house for investigation?

Witness: I didn’t go during investigation.

Defence: Did you visit the village after the investigation?

Witness: Yes, several times. But I can’t recall the dates.

Defence: Did you go to the respectable people like Chairman, Matobbor etc. at that village?

Witness: I have gone to the people of the nearby area, but I don’t know whether they are respectable or not.

Defence: Whether the Baghmara village is under the Pourosova or Union?

Witness: It is under the Kodomtola Union.

Defence: Whether you have asked the Chairman or Member?

Witness: I have gone to the local member. But I can’t recall the name.

Defence: Where is the house of the Members located at?

Witness: I don’t know. I have found him at the Union Board Office.

Defence: Who has taken you to the Baghmara village?

Witness: S.I. Badol Krishno.

Defence: Whether you have attached the out and in entry pass from the Police Station of the abovementioned S.I. Badol Krishno with the report?

Witness: No.

Defence: The report that you did not find Gonesh Chandra Saha after looking for him is false.

Witness: Not true.

Defence: Major General AKM Shafiullah, Bir Uttom is a sector commander of the liberation war.

Witness: Yes.

Defence: Afterwards he has been assigned as the Chief of the Army of Bangladesh?

Witness: Yes.

Defence: ‘Contribution of India in the war of Bangladesh’- written by Salam Azad has first been published on 2003. There is no mentioning of Mr. Sayedee on this book.

Defence: ‘Witness to Surrender’- written by Siddik Salek has first been published on 1997. There is no mentioning of Mr. Sayedee in this book.

Witness: True.

Defence: The writer of the above mentioned book at the very onset of his career life was a lecturer of Punjab University. And he was a PRO of Pakistan Army Eastern Command.

Witness: I don’t know.

Defence: Whether the book ‘To the memory of Pakistan’ has been written in the memory of Pakistan?

Witness: Yes.

Witness: It has not been mentioned in my note.

Defence: When did you gone to Parerhat bazaar to make the exhibit-40?

Witness: 19-8-2010 at 11:30 A.M. At first I have gone to the house of Ruhul Amin Nobin.
Defence: Ruhul AMin’s house is at the inner part of Parerhat Bazar.

Witness: Yes.

Defence: From whom you have collected the description of Parerhat Bazar?

Witness: Mahbubul Alam Hawladar and others.

Defence: Whether the sketch match exhibited on exhibit-40 is of 1971 or the present position of Parerhat Bazar?

Witness: It is basically made on the present condition of Parerhat Bazar. But in some places there are the mentioning of the shop owners of 1971 at the map.

Defence: There are 33 spots in this map.

Witness: Yes.

Defence: Other than the spot- Q1, W, X all other spots relate to 1971.

Witness: There were shops on the abovementioned places, the owners were Hindus. But I can’t identify them.

Defence: The spots ‘A’ ‘L’ ‘U’ ‘Y’ are respectively Rickshaw stand, Kali Mondir, Mosque, Parerhat Rajlokkhi High School. These were both there in 1971 and now.

Witness: Yes.

Defence: The owners of the shops ‘B’ ‘C’ are Rahman Kholifa and Aziz Kholifa. Whether they are alive?

Witness: No.

Defence: The owners of the shop marked from M-P, M1, O1, P1, S, T, X, Z, A1, B1 were not present during your investigation.

Witness: The Hindu people were the owners at 1971. Now the possession has been changed.

Defence: You have said: ‘you have prepared the Parerhat sketch map on the basis of present position where in some places the names of 1971 owners have been mentioned.’ It is false.

Witness: Not true.

Defence: There is no shop at the ‘B’ marked shop as has been mentioned as owned by Rahman Kholifa.

Witness: Not true. There was a house. And in 1971 there was shop of wielding.

Defence: There is a house in the ‘C’ marked place other than a shop.

Witness: Not true.

Defence. Pakistani army came Parerhat from Pirojpur city by 26 rickshaws. Did you make any investigation about those rickshaw- pullers.

Witness: I examined Mahbubul Alam and Ruhul Amin Nobi about this matter and investigated in secret.

Defence: Did you ask any rickshaw driver of Parer hat or city?

Witness: I asked many rickshaw drivers but did not take note as I did not have any result.

Defence: You did not include many subjects of investigation in your diary.

Witness: This is not true.

Defence: Is there any area of blacksmith in any place marked by D, E, F, I, J, K (exhibition-40)?

Witness: Yes.

Defence: How many blacksmiths in this area did you ask?

Witness: I asked Barik Molla and Kala Kormoker of the place marked by D.

Defence: There are 10 /15 houses and shop of blacksmith in the place marked by D, E, F, I, J, K.

Witness: Yes.

Witness: 50 years.

Defence: Is there any shop between the shop of Modan saha and Bijoy Master?

Witness: No.

Defence: Is there any shop between two shops marked by N and O?

Witness: No.

Defence: The owner the shop is not Rada Bollob. Present owner is Abis Hawlader.

Witness: Yes.

Defence: In which year Abis Haolader became the owner of this shop?

Witness: That is not in my note.

Defence: There is a road at the south side of the place marked by Q?

Witness: Yes.

Defence: Is there any shop between the shop of Chitto Shil marked by M1 and the shop of Helal Uddin Posari?

Witness: It is not shown in the sketch map.

Defence: What was the shop of Chitto Shil in the 1971?

Witness: It was the shop for hair cutting in 1971. Now it is managed by his two sons Bipul Sil and Ripon Sil.

Defence: Is the wife of Chittosil alive?

Witness: It is not in my note.

Defence: Did you speak Bipul Sil and Ripon Sil?

Witness: I am not able to say because it is not in my note.

Defence: Is Helal Uddion Posari the owner?

Witness: He died. In 1971 he was the owner. His son Abdus Salam and Kalam is the present owner.
