26 Nov 2012: Mollah 3rd defense witness

In the afternoon session, the tribunal heard the evidence of the third defence witness in the case of Mollah. His name was Muslem Uddin Ahmed (Father’s name: Late Azim Uddin Bepari, Address: Vill: Byesrosi, P.S: Sadarpur, Faridpur. Age: 65 years.) (see hearing involving second defense witness)
Defence: Tell what you know about Abdul Quader Mollah?

Witness: I and Abdul Quader Mollah studied in the same school at Amirabad Fazlul Haque Institute. Quader Mollah was one year junior to me in the school. I passed S.S.C in 1963 and Quader Mollah in 1964. I got admission in Faridpur Rajendra College after passing S.S.C in 1963 and Quader Mollah also admitted in that college next year. After that I passed B.S.C from that college in 1967. After passing B.S.C, I had joined Byesrosi Shibsundori Academy as assistant teacher.

After one year probably in September or October, Quader Mollah also joined in the same school as assistant teacher. We were continuing our teaching profession in the same school like this. Quader Mollah was staying in the house of Dhala Mia Pir Shaheb as master of Pir’s children because house of Quader Mollah was far from school. Sons and daughters of Pir Shaheb studied in that school. Probably in November or December month of 1969, Quader Mollah admitted in Dhaka University. Before admission in Dhaka University, head master of our school Babu Nolini Ranjan Shen wanted to give post of assistant head master to Quader Mollah and told Quader Mollah not to go Dhaka. After that Quader Mollah went to Dhaka for admitting in Dhaka University.

After that I had seen Quader Mollah at Sadarpur in Faridpur around eight to ten days after Bangabandhu Sheikh Mujibur Rahman's March 7 speech in 1971 and he told when I asked him that he has come to his house around four to five days after Bangabandhu Sheikh Mujibur Rahman's March 7 speech in 1971. After around one month, I had seen Quader Mollah at Chuaddarosi market and then I asked him “what you are doing now”?, he told me I am running business with the son of Dhala Mia Pir Shaheb according to the requirements of Pir Shaheb. I had seen Quder ran business in Chuaddarosi market throughout one year.

Again Quader Mollah came back to Dhaka after staying in village some months of 1972. He is a polite and good person. Quader Mollah had good relation with chairman of our school Shahjahan Talukder who was Awami league leader of our village.
Prosecutor Mohammad Ali then undertook the cross examination

Prosecution: For studying in the same school and being teacher of same school, you have good relation with Abdul Quader Mollah, am I right?

Defence: Yes and this is general.

Prosecution: Did you get any summons for giving witness from court?

Defence: No.

Prosecution: Who told you to give witness in this case?

Defence: Son of Quader Mollah told me before 8 to 10 days and before that I did not know surely whether I have to give testimony or not.

Prosecution: With whom did you come to Dhaka?


Defence: I have come myself.

Prosecution: In which date did you come to Dhaka for giving testimony?

Defence: 21-11-2012.

Prosecution: You were with people of accused party after coming 21 November 2012, is it true?

Defence: This is not true.

Prosecution: People of accused party taught you what testimony you have given in the Tribunal, is it true?

Defence: This is not true.

Prosecution: Now you are employed in “Byesrosi Islami Resource Center” which is within Sadarpur Upazila, am I right?

Defence: Yes, as care taker.

Prosecution: From which year are you employed in this resource center?

Defence: from 2007.

Prosecution: You had joined in M.A Majed Khan High School which is in Nurullagonj union of Bhanga Upazila as head master after retiring from Byesrosi Shibsundori academy in 2008, am I right?

Defence: Yes.

Prosecution: How many days were you head master of Majed Khan High School?

Defence: Around one year.

Prosecution: In a complain of indiscipline and corruption against you, a poster was published in that school with writing of “Akattorer Rajaker, ei muhurte Bangla Char (Rajaker of 1971, leave the school in this moment)”, is it true?

Defence: This is not true.

Prosecution: You became bound to leave from that school for procession and movement, is it true?

Defence: This is not true. I resigned as I wanted to.

Prosecution: You were president (Amir) of Jamaat-e-Islami of Sadarpur Upazila at the end of 1976, is it true?

Defence: This is not true.

Prosecution: Quader Mollah contested in the parliament election of 1986 and 1991 in your area as a candidate of Jamaytee Islami, am I right?

Defence: Yes.

Prosecution: How many brothers and sisters you are?

Defence: Four brothers and one sister.

Prosecution: Say the name of your brothers?

Defence: Older brother Khabir Ahmed Bepari, then Solaiman Vuiyan, then I and then elder brother M.A Fazal.

Prosecution: During the election of 1986 and 1991, you, your brothers and people of your community participated in the publicity of election in favor of Abdul Quader Mollah, is it true?

Defence: This is not true.

Prosecution: When you joined at Islamic Resource Center in 2007, B.N.P and Jamaat were in Government, am I right?

Defence: Yes.

Prosecution: As a leader of Jamayte Islami, Quader Mollah was sharer of power in 2007 and you got the job of Islamic Resource Center in his recommendation, is it true?

Defence: This is not true.

Prosecution: Your statement of meeting with Quader Mollah in Sadarpur of Faridpur after 8\10 days of Bongo Bondu’s speech of 7 Mrach, talking with him, again meeting with him after one month in Chauddarosi market, all those are false and your self-created story, is it true?

Defence: This is not true.

Prosecution: Your statement that after meeting Quader Mollah in Chauddorosi market, he told you that I am running business in Chauddorosi market with the son of Dhala Mia Pir Shaheb and you had seen him running business throughout the year of liberation war, all those are false, your self-created story for protecting Quader Mollah from charges brought against him by prosecution, is it true?

Defence: This is not true.

Prosecution: Do you know that Quader Mollah was Central leader of Islami Chatra Songo during liberation war?

Defence: I don’t know.

Prosecution: Quader Mollah was in Dhaka from March 1971 to 31st January 1972 and participated in killing, genocide and other crimes against humanity during liberation war in different area of Mirpur and Keranigonj of Dhaka with Pakistani army, is it true?

Defence: This is not true.

Prosecution: You had not seen Quader Mollah in Faridpur or in any place of Faridpur during liberation war, is it true?

Defence: This is not true.

Prosecution: Was there any list of Rajakers in Faridpur?

Defence: I don’t know.

Prosecution: Jamayte Islami and Islami Chatra Songo were involved with every crime against humanity occurred during liberation war in 1971, am I right?

Defence: I don’t know.

Prosecution: Quader Mollah was involved with the politics of Islami Chatra Songo during studying Faridpur Rajendra College, am I right?

Defence: I don’t know it but he might be involved.

Prosecution: Quader Mollah is your friend, for why you have given false statement in favor of him by concealing the truth though you know all his activities against humanity done during liberation war in 1971, is it true?

Defence: This is not true.

Prosecution: You have given false statement according to the teaching of accused party before and after coming Dhaka, is it true?

Defence: This is not true.
Then court has been adjourned for that day.
