21 Nov 2012: Molla 2nd defense witness

Defense Counsel Abdus Subhan Taroder started the afternoon proceedings by taking evidence from the second defence witness. Sushil Chandra Mondal (see previous days hearing)
Defence: What is your name and address

Witness: Father Name: Upen Chadra Mondal. Age: 82 years.Address: Vill: Amirabad, P.S: Sadorpur, Dist: Faridpur.

Defence: Do you know the accused of this case Abdul Quader Mollah?

Witness: I know the accused of this case Abdul Quader Mollah. After passing primary school, Abdul Quader admitted in the high school besides my house Fazlul Haque Institution. A BSC teacher in the name of Shantos Babu stayed in my house and some students including Quader Mollah came to our house for studying privately to that BSC teacher. Quader studied in Amirabad School staying in the house of Meher Mrida. Meher Mrida had two sons and he loved Quader as his sons. Meher Mrida gave marriage of his son with the sister of Quader Mollah being satisfied with the behavior of Quader Mollah.

After that father of Quader Mollah made a house in our Amirabad. Older sister of Quader Mollah got married in the house which is next house of our house. We were living all including family of Quader Mollah with harmony. Abdul Quader got scholarship in Primary School and passed Matriculation with first division. After passing Matriculation, Quader got admission in Faridpur Rajendra College and passed I.S.C and B.S.C from this college.

After passing B.S.C, Abdul Quder joined in Bayesrosi High School as teacher. The house of a Pir Shaheb (Saint) was besides Bayesrosi High School and two sons of Pir Shaheb studied in this school. Two sons of Pir Shaheb sat with chair and table, and other students in bench. Sons of Pir Shaheb did not stand when teacher had come. 10\15 Jakers (who recite the name of god) brought the sons of Pir Shaheb in School and took back them to house. Quader Mollah casted away the chair and table of sons of Pirshaheb outside the class and told them “learn behavior and sit with other students”. At last they become bound to sit on the bench with general students. Other teachers of that school started to say, what we could not do, Quader did that within two days and they also talked about how it was possible to cast out the chair and table of sons of Pirshaheb. After two days, Pir Shaheb informed Quader to meet with him and Quader went to meet Pir Shaheb. Pir Shaheb asked Quder Mollah, why did you cast away the chair and table of my sons?, then Quader told, have you sent your son to school only to pass by studying books or to learn behavior and showing respect to teachers and seniors. Then Pir Shaheb told, to learn courtesy with study. After hearing all story, Pir Shaheb told Quader that you did well.

There was house of another Pir Shaheb (saint) besides the house of Aatrosi Pir Shaheb whose name was Dhala Mia Pir Shaheb. Father of Quader Mollah was his follower. When Dhala Mia Pir found out that Quader Mollah is teacher in the school beside his house in which children of Pir studied then he informed Quader Mollah and told him to stay in his house for teaching his children.

May be after a year after joining Bayesrosi School, Quader went to Dhaka for higher education. After giving speech by Bongo Bondu Sheikh Mujibur Rahman in 7 March 1971, all schools and colleges became closed in Dhaka. After 6\7 days of speech of Bongo Bondu, I saw that Quader has come to his sister house beside our house. Then I asked him in which date have you come? He said, 3 days earlier and I was in the house of Dhala Mia Pir Shaheb. Quder said, Pir Shaheb has told me to stay in his house. And after that Quader started to stay in the house of Dhala Mia Pir. Pir Shaheb had shops in Chaddarosi market and he told Quader to run business in that market with his son.

Quader Mollah seldom came to the village and used to live at the house of Pir Shaheb. When we went to market, we used to see him running his business at Pir Shaheb' shop. Quader was running his business and one day our country became independent. Nine or ten months after independence, Quader again went to Dhaka for higher education. Quader Mollah is a good man
Then cross-examination of the witness was started by Prosecutor Mohammad Ali.
Prosecution: How many brothers and sisters do you have?

Witness: 3 brothers and 1 sister.

Prosecution: Say the name of your brothers?

Witness: I am older brother and other two are Parimal Chandra Mondal and Bijoy Kumar Mondal.

Prosecution: What is the profession of your two brothers?

Witness: My elder brother Parimal was primary teacher, now he is in retirement and Bijoy is doing nothing.

Prosecution: In which school Parimal was teacher?

Witness: He was teacher of different schools.

Prosecution: From which school did he retire?

Witness: I can’t say it.

Prosecution: Were you voter in the election of 2008?

Witness: Yes.

Prosecution: Can you say who were candidate of B.N.P and Awami League in the election of 2008?

Witness: I can’t say it.

Prosecution: You participated in publicity of election in favor of B.N.P candidate Shah Alam during the election of 2008, is it true?

Witness: This is not true.

Prosecution: You participated in publicity of election in favor of B.N.P candidate Shahjada Mia during the election of 1996, is it true?

Witness: This is not true.

Prosecution: From the time of election in 1996, you are involved with the politics of B.N.P and you are active worker of Bhasanchar Union B.N.P, is it true?

Witness: This is not true.

Prosecution: Who is the present Chairman of Bhasanchar Union Parishad?

Witness: Muinuddin Mollah.

Prosecution: Muinuddin Mollah is local leader of Jamayte Islami, am I right?

Witness: Yes.

Prosecution: you with local B.N.P leaders and Muinuddin Mollah, have created anarchical situation in your area for interrupting the trial of war-criminals, is it true?

Witness: This is not true.

Prosecution: Two sons of Dhala Mia Pir Shaheb are involved with the politics of local Jamaat-e- Islami, am I right?

Witness: I don’t know it because the house of Pir Shaheb is 7 miles far from our house.

Prosecution: How far is Amirabad School from your house?

Witness: Less than one-quarter of a mile.

Prosecution: Was Shudangso Shekhar Mondal a teacher of Amirabad School?

Witness: Yes.

Prosecution: How far is the house of Shudangso Shekhar Mondal from your house?
Witness: After 5\6 houses.

Prosecution: Do you know Nannu Bepari?

Witness: Yes, he is elder to me.

Prosecution: Where does he work?

Witness: I don’t know but he worked in police department in the past.

Prosecution: Do you know father of Azharul Islam late Hisab Uddin?

Witness: No.

Prosecution: Did you stay with Quader Mollah all time?

Witness: No.

Prosecution: Your statement that after 6\7 days of 7 March 1971, Quader Mollah came in the house beside your house, stayed there and talked with you, all those statement are false and you have presented false and self-created story being affected by local B.N.P leaders and brother of Quader Mollah , is it true?

Witness: This is not true.

Prosecution: Your statement that Quder Mollah was in the house of Dhala Mia Pir Shaheb and run business in the Chaddarosi market with the son of Pir Shaheb, all those statements are false and you have presented false and self-created story being affected by local B.N.P leaders and brother of Quader Mollah , is it true?

Witness: This is not true.

Prosecution: Brother of Quader Mollah and local B.N.P leaders offered you and your brother Bijoy to give a large amount of money for giving testimony in favor of Quader Mollah and you have accepted this offer but your brother have not accepted this offer, is it true?

Witness: This is not true.

Prosecution: Local BNP and Jamaat leaders and Quader Mollah's brother Muinuddin compelled you to give the false testimony threatening you with possible change in country's political scenario and enticing you by money, is it true?

Witness: This is not true.

Prosecution: Your brother Bijoy has left house in the fear of local B.N.P and Jamaat leaders because he did not agree to give false witness according the words of them, for why they gave him threat, is it true?

Witness: This is not true.

Prosecution: Did you get any summons for giving testimony from Tribunal?

Witness: No.

Prosecution: With whom have you come in the Tribunal?

Witness: With the son of Quader Mollah.

Prosecution: Son of Quader Mollah and others brought you two or three days before and have kept in their custody and taught me the testimony for giving Tribunal today, is it true?
Witness: This is not true.

Prosecution: You did not see Quader Mollah from 25 March 1971 to January 1972 in the house of village, is it true?

Witness: This is not true.

Prosecution: You have given false statement as defense witness for protecting Quader Mollah from charges brought against him by Prosecution, is it true?

Witness: This is not true.

Prosecution: Did any local Awami leader meet with you during the time before giving testimony?
Witness: No.
